California Governor Gavin Newsom signed Executive Order N-9-26 on September 18, 2026. It accelerates work on independent AI oversight and directs agencies to examine additional safeguards, including a verifiable emergency shutoff for frontier models.
The Government Operations Agency must work with emergency officials and experts to deliver recommendations by November 16. Topics include embedded independent evaluators, verified safety reporting, shutdown capabilities and broader reporting of loss-of-control incidents. The order explicitly asks for an assessment of technical feasibility and potential effectiveness.
It also sets deadlines for oversight structures already provided for in state law: criteria for independent verification organizations by May 2027 and further steps on AI auditor regulation by December 2027. Senator Scott Wiener supports the initiative in his own statement. His support does not substitute for technical testing.
The order does not mean a universal emergency brake is now operational. The additional requirements are being examined as possible changes to state law. We record the measure as a September 18 Risk Signal, not a new incident or evidence that AI control problems have been solved.
