Lori Trahan wants developers held liable for unintended AI actions. The US representative released a CLAIM Act discussion draft on October 7.
Injured non-users would be able to sue developers when an AI acts in a way that would make a person legally responsible.
The text limits liability to reasonably foreseeable injuries and excludes defamation. It would not apply when users or intermediaries intended the conduct or were negligent concerning its risk.
The draft allows claims in federal and state courts while preserving existing state remedies. Trahan is seeking feedback; the proposed liability is not yet law.
